Short answer: A business owner in Chile with no US citizenship or residence can hold a US LLC, and the work is done by All State Tax Resolution, where Sabih Shafi, an IRS Enrolled Agent, handles the Wyoming filing, the EIN without an SSN and the yearly IRS forms. Chile appears on the IRS list of tax treaties but not on Stripe's list of countries. Prices are $795 USD to form the LLC, $695 USD a year to keep it in order with the IRS and $1,395 USD for both.

Key takeaways

  • The IRS list includes an income tax treaty with Chile; its table gives January 1, 2024 as the general effective date.

  • Stripe does not list Chile among its countries. To open a business account it asks for registration in the same country, and for a US account, registration in the US.

  • PayPal does list Chile. Its help page has a general notice about some countries, with cross-border-only services and a licensed local partner for receiving money, without saying which countries.

  • With no SSN or ITIN, the EIN is requested by fax, with a general IRS window of 4 business days.

  • When the LLC has a single foreign owner and a reportable transaction, such as money you put in or take out, Form 5472 and a pro forma Form 1120 are due that year. The IRS penalty for failing to file is $25,000 USD.

  • The final decision belongs to Stripe, PayPal and the banks; we only prepare the documents.

Facts about Stripe, PayPal and the IRS on this page were checked on their official pages on October 6, 2026.

Can someone in Chile own a US LLC?

Yes. In the IRS's terms, a foreign person is an individual who is not a US citizen or resident; if that is you, you can own a US LLC even if you live in Chile.

US citizens and green card holders are outside this structure. If you are one of them and live in Chile, see our page on taxes for Americans abroad instead.

The tax treaty between Chile and the United States

The IRS publishes a list of income tax treaties, and Chile is on it; the IRS table of treaties in effect gives January 1, 2024 as its general effective date. The IRS explains that under a treaty, people who reside in the other country may pay less US tax, or none, on certain items of US-source income; how much changes depends on the country and the type of income.

What applies to your LLC depends on its income, and we review it on the call. Should Chile ask for any reporting on the LLC, a local professional takes care of it; we coordinate with them and give no Chilean rules or numbers here.

Stripe and Chile: Chile is not on the list

Stripe's global page does not include Chile, and it says that payments for businesses outside the list are not supported yet. Stripe also notes that opening a business account in a country requires a legal entity registered in that same country, and that it must support payments there.

The United States is on the list. For US accounts, Stripe requires the company to be registered in the US even if it works from another country, and it checks the company name, its entity type, its EIN, an SSN (or ITIN) and where it is located. With a single-member LLC, Stripe checks the individual owner, and if you live in a different country than the account's, it requires your passport. If you have no SSN or ITIN, let us talk before you apply; Stripe decides.

PayPal in Chile

PayPal lists Chile on its country page, and the party that contracts with you is PayPal Pte. Ltd., a company in Singapore. To open an account, a business must be organized in, operate in or reside in one of the countries on that page. The Chile help page notes that availability varies by market. It also says that for some countries services can be limited to cross-border payments and funds are received through a licensed local partner; which countries is not stated. For Chile, it says transfers to a local bank may take up to 7 business days.

A US PayPal account follows a different contract: it needs a business organized, operating or resident in the United States, and sign-up asks for a tax ID or SSN and a business bank account, among other details. PayPal decides whether to open it.

Which Chilean businesses the LLC suits

Software and design studios, food producers selling online, consultants and course creators who already have US customers fit best. For them, an LLC lets you invoice from a US company and receive dollars in an LLC account, if a bank approves it.

With inventory kept in the US, read our guide for foreign sellers first: the IRS calls profit from selling that stock effectively connected income. If you sell only in Chile, ask us before you buy.

What the LLC costs from Chile

All three packages are in US dollars:

  • Formation, $795 USD: your Wyoming LLC, with the state filing fee, a year of registered agent service, the EIN (no SSN), the operating agreement in either language, the bank and Stripe documents, and half an hour on a call with me.

  • Annual compliance, $695 USD a year: each year's Form 5472 and pro forma Form 1120, plus an extension on Form 7004 if you need one, the Wyoming annual report together with its license tax, registered agent renewal and deadline reminders.

  • Combined, $1,395 USD: formation and the first year of compliance.

All of this is for an LLC with a single owner; if partners are in your plans, we go over that on the call. Delaware or another state is done on request, and the price may vary. See the pricing and scope page.

How the EIN and the yearly report work

You send your details and, once we have what we need, the LLC is filed in Wyoming, usually within about one business day. Form SS-4 goes by fax, because the IRS online application is for people with an SSN or ITIN; if the responsible party has none and cannot get one, line 7b carries "foreign" or N/A. The general time the IRS gives for an EIN by fax is 4 business days.

Each year, if there were reportable transactions such as owner contributions or withdrawals, the LLC must send Form 5472 together with a pro forma Form 1120. Missing the filing carries a $25,000 USD IRS penalty, so it goes on your deadline calendar.
