ITIN Application: Form W-7 Guide for Foreigners (2026)

Short answer: An ITIN is a tax ID for foreigners who need a US taxpayer number but cannot get a Social Security number. You apply with Form W-7, normally filed with a federal tax return. The IRS says allow 7 weeks, or 9 to 11 in peak season or from overseas.

What an ITIN is and who needs one

An Individual Taxpayer Identification Number (ITIN) is a nine-digit number for individuals who must have a US taxpayer identification number for federal tax purposes but cannot get a Social Security number.

Typical examples are a foreign spouse or dependent on a US return, or a foreign individual with a US filing requirement of their own.

An ITIN has limits. It does not give Social Security benefits, does not change your immigration status or right to work, and filers with ITINs cannot claim the earned income credit. For tax years 2018 through 2025, the December 2024 Form W-7 instructions say a child with an ITIN cannot be claimed as a qualifying child for the child tax credit.

Who does not need one

Do not file Form W-7 if you have a Social Security number or are eligible for one. US citizens and people admitted for permanent residence or US employment are eligible for an SSN.

If you are a foreign owner getting an EIN for a US company, an ITIN is not automatically part of that. On Form SS-4, if the responsible party has no SSN or ITIN and cannot get one, you enter "foreign" or N/A on line 7b. On Form 5472, a related foreign owner without a US identifying number uses a reference ID number instead.

What Form W-7 requires

Documents. You must prove identity and foreign status with original documents or copies certified by the issuing agency. The IRS lists 13 acceptable documents. A passport is the only stand-alone document, and at least one must have a photo unless the applicant is a young dependent. Documents must be current, and the IRS returns them to you.

A tax return. A new ITIN application must include a federal tax return unless an exception applies. The IRS says to apply on or before the return due date and to put the return inside the ITIN package. The W-7 instructions describe the exceptions, and we check whether one fits your case before deciding anything.

Dependents. Dependents applying must also prove US residency in most cases. The exceptions are dependents of overseas US military and, for most credits, applicants from Canada or Mexico.

The three ways to apply

The Form W-7 instructions describe three routes:

  • By mail. Send Form W-7, the return and your documents to the IRS ITIN Operation in Austin, TX.

  • In person. Go to a designated IRS Taxpayer Assistance Center, by appointment (844-545-5640).

  • Through an agent. Use an Acceptance Agent or Certifying Acceptance Agent, in the US or abroad.

An Acceptance Agent helps complete Form W-7 and must send the IRS original documents or issuer-certified copies for all applicants. A Certifying Acceptance Agent can also verify original documents and certified copies for primary and secondary applicants and dependents, and return them immediately. Exceptions: foreign military ID cards, and for dependents only passports and birth certificates. Certifying Acceptance Agents can also work with the IRS to resolve application issues.

On cost, the IRS comparison table labels applying at a Taxpayer Assistance Center and at VITA sites "Free." It labels Acceptance Agents and Certifying Acceptance Agents "Fee-based," with fees that vary by agent.

How long it takes

The IRS says to allow 7 weeks for notice of your ITIN status. Allow 9 to 11 weeks during peak season (January 15 to April 30) or when you file from overseas. These are IRS timeframes, not a promise about your case.

Expiration and renewal

An ITIN that is not included on at least one federal tax return in 3 consecutive tax years expires on December 31 of the third consecutive year. You must renew it before using it on a return again. Renewal uses Form W-7 with the return.

An ITIN used only on third-party information returns does not need renewing until it is needed on an income tax return.

ITIN vs EIN

An ITIN identifies an individual for federal tax purposes. An EIN is the number a business entity uses, applied for on Form SS-4. A US single-member LLC owned by a foreign person needs an EIN to file Form 5472. People with no US residence or business presence cannot use the online EIN application.
