US LLC for Mexican Business Owners: Price, EIN, Dollars

Oct 6
7 min read

Short answer: Yes, a business owner in Mexico who is not a US citizen or resident can own a US LLC, and All State Tax Resolution, led by Sabih Shafi, an IRS Enrolled Agent, forms it in Wyoming, gets the EIN without an SSN and files its IRS forms each year. Formation is $795 USD, annual compliance is $695 USD a year and the two together are $1,395 USD. Because Stripe already operates in Mexico, the reason to form the LLC is not to get Stripe: it is to sell to US customers and get paid in dollars.

Key takeaways

  • A business owner in Mexico who is not a US citizen or resident can own a US LLC without living in the United States.

  • Stripe already operates in Mexico, so the LLC is not a way to "get Stripe." It is a way to have a company registered in the US.

  • PayPal Mexico says withdrawals to a local bank with a CLABE are in local currency only; to withdraw in dollars it asks for a US bank account in your name.

  • The IRS lists an income tax treaty with Mexico.

  • The EIN is requested by fax, with no SSN, and the IRS says it generally arrives within 4 business days.

Facts about Stripe, PayPal and the IRS on this page were checked on their official pages on October 6, 2026.

Can a Mexican business owner own a US LLC?

Yes. The IRS calls a person who is not a US citizen or resident a foreign person, and it applies its own rules to a single-owner LLC wholly owned by a foreign person. You can form one without living in the United States.

This structure is not for US citizens or green card holders. If that is you and you live in Mexico, read our guides on US taxes for Americans in Mexico and Mexican bank accounts and the FBAR instead.

Stripe in Mexico: the LLC is not for "getting Stripe"

Stripe's global page lists the countries where it operates, and Mexico is on it. Stripe says that where it is supported you can sell to customers anywhere in the world, and it asks for a legal entity registered in the same country where the account is opened. A Mexican business can therefore check Stripe's requirements for Mexico.

What changes with an LLC? You would have a company registered in the United States. For a US account, Stripe says registered businesses must be registered in the US, even if you operate in another country. It also verifies the entity name and type (such as LLC), the EIN, the SSN (or ITIN) and the address. Stripe lists single-member LLCs in the group that uses an SSN, where it checks the individual owner, and it requires a passport when the country of residence differs from the country of the account. Ask us first if you have no SSN or ITIN.

PayPal from Mexico: pesos with a CLABE, dollars with a US account

PayPal Mexico's user agreement is a contract with a Mexican company, and it says a legal entity must be organized in, or a resident of, Mexico. Its help page says withdrawals to a local bank (with a CLABE code) can only be made in the local currency, and that to withdraw in USD you must register a US bank account of which you are the holder.

An LLC is a company organized in the United States. Under PayPal's US user agreement, a business must be organized in, operating in or a resident of the US to open a US account. Its sign-up page asks for your legal name, tax ID or SSN, a business description and your business bank account details. PayPal decides whether to open the account.

Tax treaty and reporting in Mexico

The IRS lists an income tax treaty with Mexico. The IRS says that under these treaties residents of the foreign country are taxed at a reduced rate, or are exempt from US taxes, on certain items of income from US sources, and that the rates and exemptions vary by country and by item of income.

Whatever Mexico requires you to report for the LLC is handled by a local professional, and we coordinate with vetted local partners. We do not state Mexican rules or numbers here.

Getting paid in dollars: which Mexican businesses fit

The fit is best for owners who already have, or want, customers in the United States: development, design or marketing agencies, consultants, creators who sell online courses and e-commerce brands selling products made in Mexico. With the LLC and its EIN, those customers pay a US company; to receive dollars you need a US bank account in the LLC's name (the bank decides) and, if you take cards or PayPal, a US Stripe or PayPal account (they decide).

If you will keep inventory in the United States, read our guide for foreign sellers first: the IRS treats profit from selling that inventory in the US as income effectively connected with a US business. If all your customers are in Mexico, ask us before you buy.

Price: $795 USD, $695 USD a year or $1,395 USD

Formation in Wyoming costs $795 USD and includes the state fee, the first year of registered agent service (the local representative Wyoming requires), your EIN with no SSN, an operating agreement in English or Spanish, a bank and Stripe document pack and a 30-minute call with me about the US side of your LLC and the questions to take to a tax adviser in Mexico.

Annual compliance costs $695 USD a year and covers Form 5472 with the pro forma Form 1120, Form 7004 when you need more time, the Wyoming annual report and its license tax, registered agent renewal and deadline reminders. Formation plus the first year of compliance costs $1,395 USD. The packages are for an LLC with one owner; if you will have partners, tell me on the call. Wyoming is our standard; Delaware or another state is available on request, and the price may vary. Everything is on our pricing and scope page.

How it works: EIN without an SSN and Form 5472

You send us your details; we form the LLC in Wyoming, usually within about one business day of having what we need, and fax Form SS-4 to the IRS. If the responsible party does not have, and is ineligible to obtain, an SSN or ITIN, the IRS says to write "foreign" or N/A on line 7b. The online application is for people who have an SSN or ITIN, and the IRS says an EIN by fax generally arrives within 4 business days.

Every year, a single-owner LLC owned by a foreign person files a pro forma Form 1120 with Form 5472 when it had a reportable transaction, for example money you put into the LLC or take out of it. The IRS penalty for failing to file Form 5472 on time is $25,000 USD.
